Welcome to ElysianCurve. These Terms of Service ("Terms") govern your use of elysiancurve.com and any purchase you make from us. By using our website or placing an order, you agree to these Terms.

1. Who We Are

ElysianCurve is operated by MuseActive S.R.L., trading in Australia under ABN 24 403 320 781. Throughout these Terms, "we," "us," and "our" refer to MuseActive S.R.L. trading as ElysianCurve.

2. Eligibility

You must be at least 18 years old to place an order with us. By placing an order, you confirm that the information you provide is accurate and that you are authorised to use the payment method provided.

3. Products, Pricing & Availability

• All prices are listed in Australian dollars (AUD) and include GST where applicable.
• We take care to describe and photograph our products accurately, including sizing, fit, and fabric. Colours may vary slightly depending on your screen.
• Our range is currently offered in sizes S and M, with selected styles also available in L. Please refer to our size guide before ordering, as we generally recommend sizing down between sizes.
• We reserve the right to change prices, discontinue products, or correct pricing errors at any time before an order is confirmed. If a pricing error is discovered after you've placed an order, we will contact you before processing your payment.
• Availability is not guaranteed until your order is confirmed. Occasionally an item may sell out between browsing and checkout.

4. Orders & Payment

• When you place an order, you are making an offer to purchase. We accept your order, and a contract is formed, when we send you an order confirmation email.
• We reserve the right to refuse or cancel any order, including in cases of suspected fraud, pricing errors, or stock unavailability. If we cancel an order after payment, you will receive a full refund.
• Payments are processed securely through our payment providers, 2Checkout and PayPal. We do not store your full card details on our own systems.
• You are responsible for ensuring your payment and shipping details are correct at checkout.

5. Shipping & Delivery

• We currently ship within Australia. Delivery times shown at checkout are estimates, not guarantees, and may be affected by factors outside our control, including courier delays.
• Risk in the goods passes to you once your order has been delivered to the address provided at checkout.
• If your order is lost or arrives damaged in transit, contact us at order@elysiancurve.com and we will work with you to resolve it.

6. Returns, Exchanges & Refunds

Returns, exchanges, and refunds are handled under our separate Returns & Exchanges policy, which forms part of these Terms. Please refer to that policy for the return window, eligibility, and process.

Nothing in these Terms or in our Returns & Exchanges policy limits your rights under the Australian Consumer Law. See Section 11 below.

7. Promotional Codes & Discounts

From time to time, we may offer discount codes, including through affiliate partners. Promotional codes are valid only for the period stated, cannot be combined unless expressly stated, cannot be exchanged for cash, and may be withdrawn or amended at our discretion, except where you have already used the code on a completed order.

8. Intellectual Property

All content on elysiancurve.com, including our name, logo, product photography, and written content, is owned by or licensed to MuseActive S.R.L. and is protected by copyright and trademark law. You may not copy, reproduce, or use our content for commercial purposes without our written permission.

9. Acceptable Use

When using our website, you agree not to:

• Use the site for any unlawful purpose or in a way that could damage or impair its operation
• Attempt to gain unauthorised access to our systems or another user's account
• Use automated tools to scrape, copy, or extract content from our website without permission
• Submit false, misleading, or fraudulent information when placing an order

We may suspend or terminate your access to our website if we reasonably believe you have breached these Terms.

10. Limitation of Liability

To the extent permitted by law, ElysianCurve is not liable for any indirect, incidental, or consequential loss arising from your use of our website or products, including loss of income or delays caused by third parties such as couriers or payment processors.

This limitation does not exclude, restrict, or modify any guarantee, right, or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to resupplying the goods or services, or paying the cost of having them resupplied.

11. Your Rights Under Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law (ACL). Our goods come with guarantees that cannot be excluded, including the right to a repair, replacement, or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage.

12. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of our website will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia, without limiting any right you have to bring a claim in your local jurisdiction under consumer protection law.

13. Changes to These Terms

We may update these Terms from time to time to reflect changes in our business or for legal reasons. The version in effect at the time you place an order is the version that applies to that order. Continued use of our website after changes are posted means you accept the updated Terms.
